Booking terms
privateHOLIDAY arranges holiday accommodations in the Canary Islands in the name and for the account of the respective landlords. We are an intermediary and not a tour operator; the rental agreement is concluded exclusively between you (guest) and the landlord. In addition, the prices, additional costs, and information stated on the respective property page apply.
1. Booking and Conclusion of Contract
- By submitting the instant booking, you make a binding offer to conclude a rental agreement for the selected accommodation for the selected period. The contract is concluded upon our booking confirmation by email.
- An non-binding inquiry is not yet a booking. You will receive an offer or availability information from us; the booking becomes binding only upon your express confirmation and our booking confirmation.
- The number of persons stated in the booking (including children) may not be exceeded. Pets only with prior approval.
2. Prices and Payment
- All prices are in euros including statutory taxes. Final cleaning, additional costs, and booked additional services (e.g. cot, Wi-Fi) are shown separately on the property page and in the booking summary.
- After the booking confirmation, a deposit is due (amount according to the booking confirmation), payable within 7 days by bank transfer or PayPal. Upon receipt of the deposit, the accommodation is firmly reserved for you.
- The remaining balance is to be paid upon arrival directly to the landlord (in cash or as agreed with the landlord), unless otherwise stated in the booking confirmation.
- Any agreed security deposit is paid to the landlord upon arrival and refunded upon proper handover of the accommodation.
3. Withdrawal and Cancellation
- Withdrawal is possible at any time and must be communicated to us in writing (email is sufficient). The time of receipt by us shall be decisive.
- In the event of withdrawal, the following compensation is due (each as a percentage of the total booking price): up to 60 days before arrival 15%, 59 to 30 days before arrival 50%, from 29 days before arrival or in the event of no-show 90%.
- We recommend taking out travel cancellation insurance.
- If the accommodation cannot be provided for reasons attributable to the landlord, we will endeavor to find equivalent alternative accommodation. If this is not possible, any payments already made will be refunded in full; further claims are excluded to the extent permitted by law.
4. Arrival and Departure, Use
- Arrival and departure times as well as key handover will be communicated in the booking confirmation or by the landlord. Please let us know your expected arrival time in good time.
- The accommodation must be treated with care; house rules and quiet hours must be observed. The guest is liable to the landlord for damage caused by fault.
- Any defects must be reported immediately to the landlord or to us so that remedies can be arranged.
5. Guest Registration
Under Spanish law, landlords are obliged to record the data of all guests (name, date of birth, ID number) and transmit it to the competent authority. Please have valid identification documents for all travelers ready upon arrival.
6. Liability
- As an intermediary, we are liable only for proper brokerage, not for the performance of the landlord. The information on the accommodations is based on the landlords' information; we check this carefully, but cannot assume any guarantee for its completeness.
- For damages not based on intent or gross negligence, our liability is limited to the brokerage value of the booking, to the extent permitted by law.
7. Data Protection
We process your data exclusively for handling the booking and only pass it on to the respective landlord. Details can be found in our Privacy Policy.
8. Final Provisions
Spanish law shall apply. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected. Contact details can be found in the Legal Notice.
